The Invalidity of the North Carolina Constitution
On Tuesday morning, December 8, 2009, at 5:45 AM, Fox News commentator Bill O’reilly in an interview with Bernie Goldberg, repeated twice in succession in a statement” ( I swear to God ) ” to validate the truthfulness of a point he was trying to make.
I would endeavor that the Founders of the North Carolina Constitution in their placement of Article VI, Section 8 .Disqualifications: The following persons shall be disqualified for office:
First, any persons who shall deny the being of Almighty God, simply because if they did not believe in God; then under Section 7. (Oath) Before entering upon the duties of an office, a person elected or appointed to the office shall take and subscribe the following oath: ” I, ……., do solemnly swear(or affirm) that I will support and maintain the Constitution and laws of the United States, and the Constitution of North Carolina not inconsistent therewith, and that I will faithfully discharge the duties of my office as…….,so help me God”; has no meaning because they don’t believe in God.
Consequently, as a citizen of the State, am I suppose to take his word that he will fulfill his duties when he cannot accept the parameters of the prescribed oath written in the Constitution.
The irony for me is the prophesy of the City Attorney of Asheville, the Honorable Bob Oates gave to me yesterday, Monday, December 7, 2009 in a meeting; ” don’t be surprised if Mr. Bothwell , doesn’t have a new overnight revelation in his proclaimed status as an atheist. This morning, December 8, 2009, the Asheville Citizen Times newspaper reports that Mr. Bothwell prefers the term “post – theist in the description of himself. And that he does not deny the being of the Almighty God, he simply considers the question of denial or acceptance irrelevant.
It seems to me that he has already began practicing how to be a scalawag politician refined in the art of double talk.
It is clear that as it relates to State Rights, our Constitutional Republic is all but gone. And I wonder just how much else that is contained in the North Carolina Constitution State is trumped by the U.S. Constitution. It is clear that our Legislatures did not concur or think enough about the quoted cases in the Citizen – Times this morning to amend Article VI , section 7 or 8, thereby Mr. Bothwell’s seating as a member of the Asheville City Council according to our State Constitution is illegal.
