Special Black History Month Series – Lee County & Attorney David McCallister
Dear Ms. Lunelle,
On the morning of February 24, 2020, at the very moment that the valorous attorney, the Honorable David McCallister, climbed behind the wheel of his car to direct it to Lee County in the City of Ft. Myers, Florida, where later in the day he would stand before the Honorable Judge Thompson to argue the legitimacy in the standing of the Sons of Confederate Veterans as victims under the guise of Marsy’s Law, I knew from his swagger and demeanor that game was on and that on this day victims of crime had found their hero.
It did not take long for the fireworks to begin in Judge Thompson’s courtroom. The moment that the judge called out the case, Attorney McCallister’s posse, that has grown in numbers, stood to show their sign of support of this great man who moved to the microphone to present his argument on the recognition of the Sons status as victims of the crime in the vandalism of the Cenotaph of the Honorable General Robert E. Lee in downtown Ft. Myers.
Attorney McCallister clearly pointed out the attempts by the defendants attorney, and the state prosecutor, to shut him out of every aspect of the legal proceedings involved against the perpetrator of this heinous crime.
The now third attorney for the defendant and the state prosecutor tried to present to the court that the Sons had no standing under Marsy’s law as victims, and were not directly impacted by the crime.
Attorney McCallister would counter this argument brilliantly as he presented the economic impact that had been encumbered by the Sons, and presented to the state prosecutor and perpetrators attorney, even though they both continued to avoid co-operation with him, constantly arguing as their alibi that he had no standing in the case.
God bless Judge Thompson, who ruled that the Sons of Confederate Veterans and their attorney had standing under Marsy, no matter its limitations, and that whatever discourse was made available under the law that governs Marsy, it must be followed. And set April 7, 2020, at 10:00 AM as the date for the pre-trial conference. The courtroom would erupt with applause, and with shouts of …”thank you Judge Thompson,” as we all exited the courtroom as the state prosecutor and the perp’s attorney looked very chagrin from the blow they had been dealt.
